Terms and Conditions

The official EATN Terms of Use govern your use of the platform for ordering items from third-party Merchants and Vendors. By accessing the EATN app or website, you agree to be bound by these legal terms, including key provisions regarding account eligibility, fees and cancellations. EATN acts as an intermediary between customers and independent Merchants and Vendors. The contract for the supply of food is between you and the Merchant.

The Service

EATN provides a platform connecting customers with third-party food, beverage and grocery item providers, referred to as Merchants, and independent delivery partners. EATN acts as an agent to facilitate the order process but is not the seller of the food or other items that you purchase through the app or website.

Account Creation

Eligibility: you must be at least 18 years old to create an account.

Accuracy: you agree to provide accurate delivery addresses and contact information.

Security: you are responsible for all activity on your account. Notify us immediately of any unauthorised access.

Account suspension: EATN reserves the right to suspend or terminate accounts for misuse, fraud or breach of these Terms.

Account deletion: users may request deletion of their account and associated personal data through the app settings or by contacting support@eatn.app.

Placing Orders

Contract: a legal contract for the supply of items is formed between you and the Merchant once we send an order confirmation.

Availability: all items are subject to Merchant availability. We reserve the right to cancel orders if items are out of stock.

Allergens: Merchant menus may contain allergen information. However, it is your responsibility to contact the Merchant directly to confirm specific dietary requirements before ordering.

Price and Payment

Fees: the total price includes the cost of items, applicable taxes, a delivery fee and a service fee.

Changes: we reserve the right to change fees at any time.

Payment: payment is processed at the time of ordering via your chosen payment method.

Order: by placing an order, you authorise EATN to charge your selected payment method for the total amount.

Order errors: EATN is not responsible for delays or failures caused by technical issues beyond EATN’s control, including app outages or connectivity problems.

Data Protection and Privacy

We process personal data in accordance with UK data protection laws, including the UK GDPR and Data Protection Act 2018. By using the platform, you consent to the collection and use of your personal information as described in our Privacy Policy.

Delivery and Collection

Timelines: delivery times provided are estimates only and are not guaranteed. We and the Merchants are not liable for delays caused by traffic, weather or Merchant preparation time.

Failed delivery: if you are not available at the delivery location or do not answer the door within 5 minutes of the courier arriving, you may still be charged the full amount.

Cancellations and Refunds

Cancellations: you may cancel an order before the Merchant has begun preparing it. Once preparation has started, a refund will not be issued.

Refund policy: if items are missing, incorrect or not of satisfactory quality, you may be entitled to a refund or replacement in accordance with your legal rights. Issues must be reported to the EATN app within 24 hours. Refunds will be assessed in line with UK consumer law.

EATN will carry out its own investigation into items that are missing, incorrect or damaged. Refund requests are assessed on a case-by-case basis in line with applicable UK consumer protection laws.

EATN has the right to refuse a refund if fraud or misuse has been committed.

Age-Restricted Items

Verification: if ordering alcohol or other age-restricted goods, you must present a valid photo ID upon delivery.

Refusal: if valid ID is not provided, or if the recipient appears intoxicated, the item will not be delivered and a return fee may apply.

Limitation of Liability

Merchants are responsible for the preparation, quality and safety of the food. EATN is not responsible for the quality, safety or legal compliance of the food provided by Merchants. However, EATN will assist in resolving issues and handling complaints in accordance with applicable consumer protection laws. To the extent permitted by law, our total liability is limited to the value of your order.

Consumer Rights

Nothing in these Terms excludes or limits your statutory rights under the Consumer Rights Act 2015 or any other applicable law.

Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Acknowledgement

By using the service, you acknowledge that you have read, understood, and agree to the Terms and Conditions outlined above. Your continued use of the service constitutes your acceptance of the Agreement.
